Written Notice Reminder For WI Propane Marketers
-
10.21.2009
Here’s a question for Wisconsin propane marketers. Have you mailed your customers the required annual written notices of their duty to notify you in case they experience an interruption of propane service? If not, consider getting the notices out in your annual safety mailing this fall.
The written notice requirement is law in Wisconsin. Marketers in the Dairy State are required to give the customer written notice of the customer’s duty to notify both when the marketer first delivers propane to the customer, and then annually.
What’s included in the annual notice?
Here’s a list of what must be included in the written notice to your customers:
The marketer’s name, address, and phone number.
The purpose of giving the notification (reference to Wisconsin State Statute 101.16 (4) (b)).
A description of the type of propane gas system that is subject to the notification requirement (one or more containers or tanks having a total water capacity of at least 100 gallons).
A description of the types of activities that constitute an interruption of service, including planned or emergency repair, replacement, addition to, removal of, or service to propane gas piping or pipe fittings, pressure regulators, or replacing devices that use propane, such as a stove, furnace, or hot water heater; or running out of propane gas for any reason.
A copy of the provisions under 101.16 (4) (b). Let customers read the specific legislation and understand what is required in terms of duty to notify.
101.16 (4) (b):
1. A person who owns, leases, or uses a propane gas system and who is a customer of a retail supplier shall notify the retail supplier of propane gas for the propane gas system of any interruption in the operation of the propane gas system due to the replacement, modification, repair, or servicing of the propane gas system by any person other than the retail supplier. The customer shall provide the notice at least 7 days in advance of the interruption in the operation of the propane gas system, except as provided in subd. 2. The retail supplier, or the person replacing, modifying, repairing, or servicing the propane gas system, shall perform a check for leaks or other defects in the propane gas system before placing the propane gas system back into operation in the manner required by rule.
2. If the interruption of a propane gas system subject to subd. 1. is due to emergency repair or servicing, the customer shall provide the notice to the retail supplier as soon as possible and no later than 24 hours after the repair or servicing is completed.
